A settlement has been reached in a class action lawsuit entitledSuski et al. v. Coinbase, Inc., et al., in the United States District Court for the Northern District of California, Case No. 3:21-cv-04539-SK (the “Action”). In the Action, four individual Plaintiffs have alleged that Defendants Coinbase, Inc. (“Coinbase”) and Marden-Kane, Inc. (“Marden-Kane”) failed to adequately disclose the free entry option for a Dogecoin Sweepstakes in June 2021. Defendants dispute that contention and deny that they engaged in any wrongdoing. The Court has not decided which side is correct. The Court has preliminarily approved the proposed settlement agreement (“Settlement”), which is available on the Important Documents page of this website.
All U.S. persons who opted into the June 2021 Dogecoin Sweepstakes sponsored by Coinbase, and who bought, sold, or traded Dogecoins on the Coinbase trading platform for an aggregate $100 (USD) or more between June 3, 2021, and June 10, 2021, inclusive, may be eligible to receive a payment from the Settlement.

Summary of Your Legal Rights and Options in this Settlement | |
Do Nothing and Receive a Settlement Payment | If you are entitled under the Settlement to an award payment, you need not do anything to receive it. If the Court approves the Settlement and it becomes final and effective, members of the Settlement Class will automatically receive U.S. Dollar payments into their Coinbase accounts (if their accounts remain open) or will automatically be mailed checks to their last known mailing addresses if their Coinbase accounts have been closed or are inactive with respect to U.S. Dollar transmissions. You need not submit a claim to receive your award payment from this Settlement; all payments to members of the Settlement Class will occur automatically if and after the Court approves the Settlement. Your check will be mailed to the mailing address provided in your Coinbase account as of June 17, 2025. Exclude Yourself from the Settlement | Opt out of, and receive no benefits from, the Settlement. This is the only option that allows you to retain your right to bring your own lawsuit against either Defendant regarding the Dogecoin Sweepstakes sponsored by Coinbase, and administered by Marden-Kane, in June 2021. |
Object | Write to the Court if you wish to object to the Settlement. Objecting will not cause the Court to change the terms of the Settlement agreement. The Court can only approve or reject the Settlement in response to objections. |
Attend a Court Hearing | Ask to speak in Court about the fairness of the Settlement. You may speak at a hearing about the fairness of the Settlement, if you submit an objection that complies with requirements in Question 16. |

If the Court does so, and any appeals are resolved in favor of the Settlement, then payments will be distributed to members of the Settlement Class.
